“Style n’yo, bulok. Hindi na uubra ang mga maanomalyang dummy bidding sa mga proyekto ng gobyerno sa bisa ng New Government Procurement Act (NGPA).
Ito ang binigyang-diin ni Department of Budget and Management (DBM) Secretary Amenah Pangandaman, matapos niyang isa-isahin ang mga mahahalagang salik ng New Government Procurement Law (NGPA), kung saan ang isa ay tinatawag na mandatory disclosure of beneficial ownership information o paglantad ng mga impormasyon tungkol sa may-ari o sinumang may impluwensya o kontrol sa isang kumpanyang sumasali sa public procurement.
Nakasaad ang disclosure of beneficial ownership information sa Sections 81 at 82 ng NGPA, o Republic Act No. 12009, na pinirmahan ni Pangulong Ferdinand R. Marcos Jr. noong Hulyo 2024.
“Makapangyarihan po ang disclosure of beneficial ownership sa ating bagong batas dahil sinisiguro nito na maiiwasan ‘yung conflicts of interest sa public procurement. Sinasarado natin ‘yung tsansa na makalusot ‘yung korapsyon at mga sabwatan sa bidding ng mga proyekto. Sa ilalim ng NGPA, hindi na uubra ‘yung palit-pangalan, palit-ulo, at dummy owners,” ayon kay Secretary Pangandaman.
Giit pa ni Sec. Pangandaman, paiigtingin ng disclosure of beneficial ownership ang integridad, epektibong kumpetisyon, at full transparency sa public procurement process.
Mahalaga ang probisyong ito na nakasaad sa NGPA lalo pa’t ayon sa pag-aaral na isinagawa ng GPPB-Technical Support Office (GPPB-TSO), napag-alamang karamihan ng mga bidders sa public procurement ay may common owners.
“Based on a 2023 TSO survey, we found out that 65.8% of bidders have common owners, based on a random sampling of 180 procuring entities. Meanwhile, we found out that 71.6% of bidders were related sa government officials. With the disclosure of beneficial ownership in place, we can deter unfair competition in public contracts and improve our services to benefit our citizens,” ani GPPB-TSO Officer-in-Charge Atty. Maria Dionesia Rivera-Guillermo.
Kaugnay ng nasabing probisyon sa NGPA, kabilang na rin sa mga eligibility documents na nararapat isubmit sa Philippine Government Electronic Procurement System (PhilGEPS) ng Procurement Service – Department of Budget and Management (PS-DBM) ang beneficial ownership information para sa pagkuha ng PhilGEPS Platinum registration, na kinakailangan ng mga bidders sa kanilang pagsali sa public procurement. Ang requirement na nabanggit ay sang-ayon sa Section 20.2.9.1(b) ng Implementing Rules and Regulations (IRR) ng NGPA na inaprubahan ng GPPB, sa pangunguna ni DBM Secretary Pangandaman, bilang Chairperson nito, noong Pebrero 4, 2025.
“Sa ngayon po, out of 12,769 PhilGEPS Platinum-registered corporations for this year, 6,766 pa lang ang nakakapagsubmit ng beneficial ownership or BO information document sa PhilGEPS. The non-submission of BO document automatically suspends the Platinum registration, which is the lone eligibility document required from bidders. That way po, we can ensure that only those bidders with disclosed beneficial owners can participate in the public bidding of government projects; and those beneficial owners should not have conflict of interest with the procuring entity and with the other participating bidders,” ayon kay PS-DBM Executive Director Genmaries Entredicho-Caong.
Sa gitna ng pagpapatupad ng bagong procurement law, pinangungunahan ng GPPB, sa pamamagitan ng PS-DBM PhilGEPS, katuwang ang mga partners tulad ng World Bank at Open Ownership, ang pagtatag ng public online beneficial ownership registry of bidders at analytical tool prototype na maaaring gamitin ng mga procuring entities para salain ang mga mahahalagang impormasyon at maiwasan ang pagkakaroon ng anomalya.
Bukod sa pag-iwas sa conficts of interest at pagsawata sa dayaan sa bidding, ang paglimbag ng impormasyon tungkol sa mga bidders, merchants, at contractors ay magbibigay-daan sa mas maigting na oversight at accountability o pananagutan sa tulong ng civil society at ng mismong publiko.
Itinataguyod ng NGPA ang transparency, accountability at mas pinalakas na partisipasyon ng publiko na mga prinsipyong pinaiiral ng DBM, sa ilalim ng Philippine Open Government Partnership.
